PHILOSOPHY
BRIEF DOCTORtm is built on
three decades of experience and a few basic ideas. Every
writer needs a good editor. Some cases benefit greatly from
input by someone other than the lawyers processing them.
Many lawyers have either forgotten or never learned how the
art of storytelling can serve their clients.
Over the years I've learned that often lawyers win and lose
cases based on how well they tell their clients' stories.
That's because every case and every deal tells a story
filled with characters or parties, evidence including dialog
and written materials, and events or plot which become the
claims for relief.
I am a lawyer and BRIEF DOCTORtm
is nothing more than a label--a service mark--denoting parts
of my practice. But they're the most important parts because
they combine my writing, teaching and lawyering skills.
AVAILABLE SERVICES
I am available to work with other lawyers in several ways. I
can write, edit or rewrite briefs at both trial and
appellate levels. I can provide analysis and structuring of
arguments and positions. I can provide safe and secure
second opinions. Because I have extensive transactional
experience, I can also help structure and effect tough
deals. Mostly I can help you tell your clients' stories more
effectively.
TYPICAL APPROACH
Usually a lawyer with a troubling case--one with complex
facts or unusual issues or one that just doesn't fit the
lawyer's style--will contact me. Often we can determine
whether I can be of assistance over the phone or by meeting
for a brief consultation. All of my services are subject to
written engagement agreements and the rules of professional
conduct and canons of ethics in the State of Colorado. My
rates can be fixed, hourly, flexible, or based on the
project. The scope and fees for my engagement will be
tailored to each engagement.
MY FOCUS
I stress creative thinking and searching for solutions that
are out of the box. I believe legal writing should be tight
and precise. Arguments should be simple and carry a theme.
The structuring and analysis of issues and facts early in
the process of case development can be critical in telling
your clients' stories effectively.
Most importantly, writing is
communication. A writer and lawyer should never forget
who the audience is. Often it's the judge. But whether it's
a judge, jury, client or opposing counsel, if the audience
doesn't properly receive the message being sent, then no
amount of good intent on the part of the sender matters.
SECOND OPINIONS
I am available to render safe and secure second opinions.
This is an outgrowth of the work I do on structuring and
analysis. But I am aware that lawyers--unlike
doctors--seldom get involved in second opinions. They don't
want someone poaching their clients. My second opinions are
"safe and secure" in the sense that I am not out to steal
your cases or clients. You do what you do well and I do what
I do well. And what I do is help you look better--to your
clients and the courts before which you appear.
